Policies at Herwin Safety, Inc.

SPECIAL ORDER ITEMS

Non-stock items are considered to be special order and are non-returnable. A formal quotation will be faxed, emailed or mailed. An authorized signature will be needed on quotation and quotation must be returned prior to proceeding with order.

You will be notified if items in your order are considered to be special order at time of order placement. “Special order/non-returnable” will be noted on emailed or faxed copy of credit card sales form for an authorized signature.

BACK ORDER ITEMS

Shipment on back ordered-stock items is typically 3-4 weeks from receipt of original order. You will be notified of back ordered items at that time.

PAYMENT TERMS

Our preferred payment is via VISA, MasterCard or American Express. If a customer wants to establish open credit, we welcome their inquiry. Credit will be predicated on the completion of our standard credit application and acceptance and approval of Herwin Safety, Inc. accounting department. A 3.5% surcharge will be added to credit card orders in the amount of $2,500 and above.

SALES TAX

Buyer is responsible for all local and state sales and use taxes applicable to all transactions. Please refer to your tax professional if your purchases are exempt. Resale dealers must have Sales Tax Exemption for Resale Form on file prior to shipment.

DUTIES

Buyer is responsible for all duties applicable to all transactions.

Models, pricing and specifications are subject to change.

FORCE MAJEURE

Herwin Safety, Inc. shall not be liable for any delay in or impairment of performance resulting in whole or in part from Acts of God, labor disruptions, shortages, inability to procure product, supplies or raw materials, severe weather conditions or any other circumstances or cause beyond the control of Herwin Safety, Inc. in the conduct of its business.

RETURNS & CANCELLATIONS

All returns must be approved by Herwin Safety, Inc. and must be within (5) days from receipt of order.

Return of stock items will be subject to a 20% restocking charge. A restocking fee will be waived if a different size item is ordered in place of the returned standard product. Shipping charges will not be credited. Item must be returned Freight-Prepaid and in new condition. Special ordered items are not returnable.

Any cancellation must be approved by Herwin Safety, Inc. and may be subject to restocking and other charges. No cancellation will be applicable to special order items.

SHIPPING CHARGES

Freight and shipping charges will be charged to customer’s shipping location, using a carrier of our choice. We will be happy to accommodate using a customer’s preferred carrier on Freight Collect shipments. Please note: Title and risk of loss is passed on to the customer when freight carrier receives products at Herwin Safety, Inc. shipping locations.

If product is damaged or quantity shipped is incomplete, customer (consignee) must file freight claim with carrier.

DAMAGE CLAIMS

All damage claims must be documented as damaged upon receipt from carrier and Herwin Safety, Inc. must be notified immediately at 1-800-868-5438. You will then be assisted as to what necessary steps need to be taken.

QUANTITY & ITEM DISPUTES

Herwin Safety, Inc. must be notified upon receipt of order of any quantity or item disputes  from receipt of order. Please have copy of packing slip and/or bill of lading available when calling 1-800-868-5438.

WARRANTY

Herwin Safety, Inc. published warranty is applicable to equipment used under normal conditions and has not been abused.

Warranty procedure:

  • Please call Herwin Safety, Inc. at 1-800-868-5438 with invoice number, item and description of defect.
  • Any item which is determined by Herwin Safety, Inc. to be defective in material or manufacturing defects will be returned for warranty evaluation.
  • Herwin Safety, Inc. will replace or repair the product at it’s discretion, if upon inspection the product is found to be defective.
  • Freight carrier will be selected by Herwin Safety, Inc. and shipping costs for the return and/or replacement will be paid by Herwin Safety, Inc. if product is found to be defective. If product is found not to be defective, purchaser will be responsible for applicable freight charges.

PRODUCT SUITABILITY

Many states and localities have codes and regulations governing sales, construction, installation and/or use of products for certain purposes, which may vary from those neighboring areas. While Herwin Safety, Inc. attempts to assure that it’s products comply with such codes, it cannot guarantee compliance and cannot be responsible for how the product is installed or used. Before purchase and use of a product, please review the product application, national and local codes and regulations, to be sure that the product, installation and use will comply with the governing regulations.

PRIVACY POLICY

We may track the intended domain address from which visitors tour our website and analyze this data for trends and statistics. Individuals will remain anonymous unless they voluntarily tell us who they are.

When you order a product, ask for a quotation or other general inquiry, we will ask for certain information about yourself and company. This information such as your name, shipping address, billing address, telephone number, fax number, email address, credit card information, purchase order and occupation title, will be maintained on an offline record of your purchase and inquiries.

Your personal information will be kept confidential at Herwin Safety, Inc. and will only be shared with third parties that are involved in your transaction. Third parties would include credit card companies, freight carriers, installers or authorized dealers.
